The SC crime of “assault and battery by mob,” or lynching, is when two or more people assault someone.

It is considered a more serious crime than an assault and battery committed by one assailant, and the penalties are harsher than the penalties for assault and battery offenses:

Assault and Battery by Mob in the First Degree

First degree assault and battery by mob is where two or more people assault someone, and the victim dies. Assault and battery by mob in the 1st degree is punishable by 30 years up to life in prison.

Assault and Battery by Mob in the Second Degree

Second degree assault and battery by mob is when two or more people assault someone, and the attack results in serious bodily injury. Assault and battery by mob in the 2nd degree carries a potential sentence of three to twenty-five years in prison.

Assault and Battery by Mob in the Third Degree

Third degree assault and battery by mob is when two or more people assault someone, and it results in bodily injury. Assault and battery by mob in the 3rd degree is punishable by up to a year in prison.
